Terms of Use
End User License Agreement · Last updated: 17 October 2026
These terms are an agreement between you and Vellix Ventures LLC ("we", "us") for your use of the BackPain app. By downloading or using the app, you agree to them. If you don't agree, please don't use the app.
BackPain is not medical advice. The exercises, articles, Coach replies and community posts are for general wellness and education only. They do not diagnose, treat, cure or prevent any condition, and they don't replace a doctor, physiotherapist or other qualified professional. Talk to a healthcare professional before starting any exercise programme, especially if you have a medical condition, are pregnant, or have recently had surgery or an injury.
Stop any exercise that causes sharp, shooting or worsening pain. Get emergency help immediately if you have new numbness around your groin or buttocks, new problems controlling your bladder or bowels, worsening weakness in your legs, chest pain, or back pain after a serious accident. Never ignore or delay professional medical advice because of something you read or heard in the app.
1. Who can use BackPain
You must be at least 16 years old to use BackPain. By using the app you confirm that you are, and that you're able to agree to these terms.
2. Your licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to use BackPain on Apple-branded devices that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions. You may not copy, modify, distribute, sell, rent, reverse engineer or create derivative works of the app, except where the law expressly allows it.
3. Accounts
You can use the core app without an account. The Community, cloud backup and, on iPhones without Apple Intelligence, Coach require you to sign in with Apple. You're responsible for activity on your account and for keeping access to it secure. You can delete your account at any time in the app under Profile → Delete account.
4. Premium subscriptions
- What you get: BackPain Premium unlocks full-length personalised sessions, every exercise, the complete article library and a higher daily Coach allowance. The features included may change over time, but we won't remove the core value of your subscription during a period you've paid for.
- Billing: payment is charged to your Apple ID at confirmation of purchase. Prices are shown in the app before you buy and may vary by country.
- Auto-renewal: your subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the period.
- Free trials: if a free trial is offered, you'll be charged the subscription price when the trial ends unless you cancel at least 24 hours before it ends. Any unused part of a free trial is forfeited when you buy a subscription.
- Cancelling: manage or cancel at any time in your iPhone's Settings → [your name] → Subscriptions. Cancelling stops future renewals. You keep Premium until the end of the period you've paid for.
- Refunds: purchases are handled by Apple, so refund requests go to Apple at reportaproblem.apple.com, under Apple's policies.
- Price changes: if the price changes, Apple will notify you in advance as required, and you can cancel before the new price applies.
5. Coach (AI)
Coach is an artificial intelligence assistant, not a person and not a healthcare professional. Its replies are generated automatically and may be inaccurate, incomplete or unsuitable for you. Use your own judgment and check with a professional before acting on anything important. Coach can't examine you, diagnose conditions, prescribe treatment or respond to emergencies.
Coach has daily message limits, which may differ for free and Premium users and may change. Please don't share information that identifies you or others, like full names, addresses or medical record numbers. You can report a Coach reply by pressing and holding it. Our Privacy Policy explains how Coach messages are handled.
6. Community and your content
There is zero tolerance for objectionable content or abusive users. By joining the Community you agree to our Community Guidelines. In particular, you must not post content that is harassing, hateful, sexually explicit, violent, threatening, illegal, spam or advertising, or that encourages self-harm or gives dangerous medical instructions.
You keep ownership of what you post. You give us a worldwide, non-exclusive, royalty-free licence to host, store, display and distribute your posts within BackPain so the Community works. This licence ends when you delete the content or your account, except where others have already re-shared it or we must keep it for legal reasons.
You're responsible for what you post, and you confirm you have the right to post it. Other members' posts are their own views, not ours, and are not medical advice.
Members can report content and block other members. We review reports, aim to act within 24 hours, and may remove content or suspend or permanently ban members who break these terms or the Community Guidelines, without notice. Content reported by several members may be hidden automatically while we review it.
7. Acceptable use
You agree not to:
- break the law or anyone's rights, including privacy and intellectual property rights;
- impersonate anyone or misrepresent your qualifications, for example claiming to be a doctor;
- scrape, hack, overload, or interfere with the app or its servers, or get around usage limits or security;
- use the app or Coach to build a competing product, or use automated means to access it;
- use the app to send spam, advertising or malware.
8. Third-party content and links
BackPain may link to products, podcasts and websites run by others, such as Amazon. We don't control them and aren't responsible for their content, products or practices. Product suggestions in the Shop are general ideas, not medical recommendations, and are sold by third parties under their own terms. As an Amazon Associate we earn from qualifying purchases.
9. Our intellectual property
The app, its exercises, articles, design, code and branding belong to us or our licensors and are protected by law. These terms don't give you any rights to them other than the licence in section 2.
10. Disclaimers
To the fullest extent the law allows, BackPain is provided "as is" and "as available". We make no warranties of any kind, whether express or implied, including that the app will be uninterrupted, error-free or suitable for your particular needs, or that it will reduce your pain. Exercise involves some risk of injury. You take part voluntarily and are responsible for exercising within your own limits. Nothing in these terms limits rights you have under consumer protection laws that can't be excluded.
11. Limitation of liability
To the fullest extent the law allows, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the app. Our total liability for any claim relating to the app is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US $50. These limits don't apply to liability that can't be limited by law, such as for death or personal injury caused by our negligence, or for fraud.
12. Indemnity
To the extent the law allows, you agree to indemnify us against claims, losses and costs arising from content you post or your breach of these terms.
13. Ending these terms
You can stop using BackPain and delete your account at any time. We may suspend or end your access if you break these terms, if we're required to by law, or if we stop offering the app. Sections that by their nature should survive (such as 6, 9–12 and 15) continue after these terms end.
14. Apple App Store terms
If you downloaded BackPain from Apple's App Store:
- These terms are between you and us only, not Apple. We, not Apple, are solely responsible for the app and its content.
- Your licence is limited to using the app on Apple-branded products you own or control, as permitted by the App Store Usage Rules, except that the app may be accessed by other accounts associated with you through Family Sharing or volume purchasing, where available.
- We are solely responsible for providing maintenance and support. Apple has no obligation to provide any maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
- We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the app or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms (for example, your mobile carrier's terms) when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
Questions, complaints or claims about the app should be sent to us using the details in section 17.
15. Governing law and disputes
These terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law rules. Disputes will be handled by the state and federal courts located in New Mexico. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live and can bring claims in your local courts. Before starting a formal dispute, please contact us so we can try to resolve it informally.
16. Changes
We may update these terms from time to time. If changes are significant, we'll let you know (for example, in the app) before they take effect. If you keep using BackPain after the changes take effect, you accept the updated terms.
